Recent developments on aid measures Corona crisis

The rise of the omikron variety prompted the government to declare another lockdown. A slap in the face for entrepreneurs in sectors that were often already facing restrictions. Fortunately, most entrepreneurs are eligible for support measures. We would like to inform you about the latest status of the support measures TVL and NOW.

TVL

Contrary to earlier reports, the TVL Q3 2021 will be followed up after all. The outgoing cabinet has decided to make both a TVL Q4 2021 and a TVL Q1 2022 available. This means that entrepreneurs struggling with the financial consequences of the corona measures will be able to rely on government support to meet fixed expenses at least through March 2022. Below we list the main conditions for both schemes.

TVL Q4 2021

  • The company was registered with KVK on June 30, 2020;
  • The company suffers at least 20% turnover loss compared to the reference period. In principle, the turnover loss is calculated on the basis of the VAT return;
  • The entrepreneur may choose the reference period, having the choice between Q4 2019 and Q1 2020;
  • The subsidy rate is 100% of the firm's fixed expenses (CBS average);
  • Application for TVL Q4 2021 is possible until 5 p.m. on January 28, 2022.

TVL Q1 2022

  • The company was registered with KVK on June 30, 2020;
  • The company suffers at least 30% turnover loss compared to the reference period. In principle, the turnover loss is calculated on the basis of the VAT return;
  • The entrepreneur may choose the reference period, the reference months have not yet been announced.
  • The subsidy rate is 100% of the firm's fixed expenses (CBS average);
  • It is not yet clear when the application window for the TVL Q1 2022 will open.

Postponed deadline for setting TVL Q2 2021

Entrepreneurs who applied for TVL Q2 2021 must submit a determination request by March 8, 2022. Originally, the deadline was set for January 11, 2022. In the determination request, actual sales for the period April through June 2021 should be forwarded.

NOW

The NOW scheme will also be followed up in the form of the NOW-5 (November and December 2021) and the NOW-6 (first quarter 2022) available. The NOW-6 is currently only announced but not yet developed and enacted.

However, the NOW-5 is already open. Businesses experiencing a loss of sales of at least 20% in the months of November and December 2021 compared to 1/6 of 2019 sales can apply through the UWV website until January 31, 2022.

The conditions for the NOW-5 are largely the same as for the NOW-4, namely:

  • The company has a revenue loss of at least 20%;
  • The company receives compensation of 85% of the reported loss of sales;
  • The fee is increased by a flat 40% surcharge;
  • Compensation per employee is up to 2 times maximum daily wage;
  • The company applying for NOW, if the advance received or the final grant exceeds €125,000, may not pay bonuses or dividends for 2021 or buy back its own shares. If the exception to apply at the operating company level is used, the dividend ban applies to the entire group.

Compared to previous NOW periods, some changes are being made:

  • The reference month for the wage bill will be September 2021;
  • The employer may report a turnover loss of up to 90% (even if the turnover loss is estimated between 90% and 100%);
  • For all companies, the turnover loss will be calculated for the months of November and December 2021. Thus, employers can no longer choose which months to have the turnover loss calculated for;
  • The UWV pays the advance in 1 lump sum;

Finally, the NOW-5 also provides for a start-up scheme. This means that entrepreneurs who started their businesses after February 1, 2020, but no later than September 30, 2021, can also qualify for the NOW-5.
